Q
Can I make a Debt Arrangement Scheme (DAS) Application?
A
The Debt Arrangement Scheme (DAS) is a Scottish Government run debt management programme that was designed to help as many people as possible to repay their debts.
To be eligible for DAS, you must:
- be resident in Scotland
- been assessed by a DAS approved money adviser
- have a ‘reasonable’ level of disposable income after essential living costs have been accounted for
However, you would not be eligible if:
- you are in a Protected Trust Deed
- you are an undischarged bankrupt or subject to a bankruptcy restrictions order
- your DAS application only includes one debt and you are subject to a time to pay direction under section 1 (time to pay directions) or section 5 (time to pay orders) of the Debtors (Scotland) Act 1987, in relation to that debt
- your DAS application only includes one debt and is subject to a time order under section 129 (time orders) of the Consumer Credit Act 1974 (d), in relation to that debt
- you are paying a debt(s) under a conjoined arrestment order
Couples can apply for a joint Debt Payment Plan (DPP) if they each have one or more qualifying debts and fall into one of the following categories:
- husband and wife or living together as husband and wife
- civil partners
- living together in a relationship with the characteristics of a husband and wife relationship, except that they are of the same sex
