Do I qualify for a Debt Relief Order?


For your Debt Relief Order application to be considered by the Official Receiver, you must meet the following criteria:

  • You must be insolvent, which means you must unable to make your contracted repayments after your essential expenditure and living costs have been accounted for. An specialist debt advisor will help you determine whether this is the case or not.
  • The total of your qualifying debts (see What debts can I include in Debt Relief Order?) must not exceed £20,000.
  • Your surplus income (this is the amount you have left over each month after your living costs and essential expenditure have been taken into account) does not exceed £50.
  • Total non-vehicle asset value must not exceed £1,000.
  • Total vehicle asset value must not exceed £1,000.
  • You must not have had a DRO during the previous six years.
  • You must either be living in England or Wales or have been resident or carrying on business in England or Wales at some point during the last three years.
  • At the time of applying for the DRO, you must not be involved in any other insolvency process including:
    • Bankruptcy (including petitioning for Bankruptcy)
    • IVA
    • Bankruptcy Restrictions Order
    • Debt Relief Restrictions Order
    • Interim Order
